
Extensions to Spanish Stay and Work Permits

Order SND/421/2020 published on the 8th May outlines measures relating to the extension of residence and work permits for foreigners in the wake of the state of alarm.
EXTENSION OF TEMPORARY RESIDENCE, STAY AND WORK PERMITS
➡ Permits that expire during the state of alarm or expired in the 90 calendar days prior to the state of alarm will be automatically extended, without the need for an individual resolution to be issued by the Immigration Office.
➡ The automatic extension will start on the day after expiry and will last until 6 months after the end of the alarm state.
➡ This extension will apply regardless of whether requests for renewal, extension or modification have already been submitted, provided only that these applications have not been resolved. If an application has already been resolved and has been successful, then the extension does not apply.
➡ Subsequent applications may be filed throughout the extension period or up to 90 days after the extension expires. If the application is successful but submitted after the expiry date, the start date for the new permit will be based on the original expiry date.
ENTRY INTO SPAIN OF HOLDERS OF A RESIDENCE OR STAY PERMIT.
➡ Whose with a residence or ‘stay’ permit may enter Spain with valid travel documents and an expired foreigner’s identity card.
EXTENSION OF COMMUNITY FAMILY MEMBER CARDS
➡ Similarly, if a community family member card has expired during the state of alarm or in the 90 days prior, it will be automatically extended for 6 months from the end of the state of alarm.
EXTENSION OF FOREIGNER IDENTITY CARDS GRANTED ON THE BASIS OF A LONG-TERM CARD
➡ If a long-term TIE has expired during the state of alarm or in the 90 days prior, it will be automatically extended for 6 months from the end of the state of alarm.
EXTENSION OF TOURIST STAYS
➡ Those in Spain for a period not exceeding 90 days – ie the permitted length of a tourist visit – whose stay has been affected by the state of alarm will be automatically be permitted to stay for three more months. This validity will be limited to Spanish territory.
ABSENCES FROM SPANISH TERRITORY
➡ For the those that need to prove their continued residence in Spain, absence from Spanish territory as a result of Covid19 will not be counted.
