Tax amnesty for pensioners in Spain

There is a tax amnesty for pensioners in Spain – who receive a pension from another country and are not yet declaring it in Spain!  If this is you – or someone you know – then be aware that you have until the end of June 2015 to put your papers in order without facing any penalty or surcharge.

This tax amnesty for pensioners in Spain affects foreigners resident in Spain and Spanish nationals who have worked abroad.

If before June pensioners hand in tax documents reflecting the undeclared income they have received in the form of foreign pensions in the last four years, they will only have to pay any tax due, whilst avoiding penalties or surcharges.

If you have already submitted your tax documents and have paid surcharges, these payments will be refunded in the first six months of this year.

The Spanish Tax Office is inspecting more and more foreigners and Spaniards receiving pensions from abroad. The increasingly closer exchange of information and data between the various European tax authorities has made the Spanish Tax Office aware of how many foreign pensioners do not pay tax at all – on their foreign pensions here!

That said, some clients are already protesting – claiming that the pensions received are less than the minimum income required to make an obligatory tax declaration and therefore they should not have to pay tax.

However, if this is your case and the Spanish Tax Office inspects you then you must ensure that you have the official documents proving that your pension payments are below the minimum taxable.

Meanwhile, be aware that if you reside in Spain for more than 183 days in a year (a calendar year) then you are automatically classed as a resident for tax purposes, and as a consequence your worldwide income must be taxed in Spain. Be aware that the Spanish Tax Office can check by looking when you registered yourself in the Municipal Register of Inhabitants (“padrón”).

So, if you want to take advantage of the tax amnesty for pensioners in Spain then I suggest that you move quickly!  Of course, if you want any help I taking advantage of this amnesty – then contact me now.
